Crescent Wellness LLC ("Crescent," "we," "us," or "our") operates crescentlabs.co and sells nutritional supplement products directly to consumers. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit or use our website, make a purchase, or otherwise communicate with us (collectively, the "Services").

If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

Please read this Policy carefully. By accessing or using the Services, you acknowledge that you have read and understand the practices described here. This Policy does not apply to third-party websites or services we link to, which have their own privacy practices.

Information We Collect

When we use the term "personal information," we mean information that identifies or can reasonably be linked to you. It does not include information collected anonymously or that has been de-identified so that it cannot reasonably be linked to you.

Depending on how you interact with the Services, we may collect or process the following categories of personal information, including inferences drawn from that information:

Information you give us

  • Contact and identity information — name, email address, phone number, shipping address, and billing address.
  • Order and transaction information — products you view, add to your cart, or purchase; order value; subscription selections and frequency; discount codes used; returns, exchanges, and cancellations; and your order history.
  • Payment information — the form of payment you use, transaction details, payment confirmations, and the last four digits and expiration date of your payment card. Full payment card numbers are collected and processed directly by our payment processors. We do not receive or store full payment card numbers.
  • Account information — if you create an account, your username, password, preferences, and saved settings.
  • Communications — the content of messages you send us by email, text, or through contact forms, including customer support inquiries, and any product reviews or feedback you submit.
  • Marketing preferences — your email and SMS subscription status and the records of the consent you provided.

Information we collect automatically

  • Device and technical information — IP address (which may be used to determine general location), browser type and version, operating system, device identifiers, cookie IDs, and network connection information.
  • Usage information — pages and products viewed, time spent on pages, referring website, search terms used to reach or navigate our site, and actions such as adding items to a cart or beginning checkout.
  • Cookies and similar technologies — see the Cookies and Tracking Technologies section below.

Information we receive from others

  • From Shopify and our payment providers — order, fulfillment, fraud-screening, and payment confirmation information.
  • From advertising and analytics providers — information about how you found our site and whether you interacted with our advertisements.
  • From shipping carriers and fulfillment providers — delivery status and address validation information.
  • From other partners and third parties — where they collect or process personal information on our behalf.

How We Use Your Information

We use personal information to:

  • Provide and improve the Services. Process, fulfill, and ship your orders; manage subscriptions and recurring charges; create and maintain your account; arrange shipping; handle returns, exchanges, and refunds; enable you to post reviews; remember your preferences; and personalize your shopping experience, including recommending products.
  • Communicate with you about your orders. Send order confirmations, shipping notifications, subscription renewal reminders, receipts, and other transactional messages.
  • Provide customer service. Respond to your questions, requests, and complaints, and maintain our business relationship with you.
  • Market and advertise. Send marketing communications by email and, where you have provided the required consent, by text message; show you advertisements for our products on our site and on other websites and social media platforms, including based on your prior browsing and purchase activity.
  • Measure and analyze. Understand how our website, products, and campaigns perform so we can improve them.
  • Protect security and prevent fraud. Authenticate your account, provide a secure payment and shopping experience, and detect, investigate, and take action on fraudulent, unlawful, or malicious activity. If you create an account, you are responsible for keeping your credentials secure. We recommend you do not share your username or password with anyone.
  • Meet legal obligations. Comply with applicable law, respond to valid legal process including requests from law enforcement or government agencies, participate in litigation or civil discovery, and enforce or investigate potential violations of our terms and policies.

Cookies and Tracking Technologies

We and our service providers use cookies, pixels, tags, and similar technologies to operate our site, remember your preferences, understand how our site is used, and deliver and measure advertising. These fall into the following categories:

  • Strictly necessary — required for the site to function, including maintaining your shopping cart, processing checkout, and security. These cannot be turned off.
  • Analytics and performance — help us understand how visitors use our site so we can improve it.
  • Marketing and advertising — used to deliver advertising relevant to you and measure campaign effectiveness, including on third-party platforms.

You can manage your preferences at any time using the cookie preferences link in our website footer, or by configuring your browser to refuse or delete cookies. Some parts of our site may not function properly if you disable certain cookies.

We honor Global Privacy Control (GPC) and similar browser-based opt-out preference signals as valid requests to opt out of the sale or sharing of personal information for the browser and device transmitting the signal. To learn more about Global Privacy Control, visit https://globalprivacycontrol.org/. Other than GPC, we do not currently respond to "Do Not Track" signals.

How We Disclose Your Information

We do not sell your personal information for money. We do disclose personal information to the following categories of recipients:

  • E-commerce and hosting platform — Shopify, which hosts our online store and processes orders on our behalf. See the Relationship with Shopify section below.
  • Payment processors — to process payments, prevent fraud, and handle refunds and chargebacks.
  • Fulfillment, warehousing, and shipping providers — third-party logistics providers and shipping carriers who store our inventory, pick and pack orders, and deliver packages to you. These providers receive your name, shipping address, phone number, and order contents.
  • Subscription management providers — to create, manage, modify, and cancel recurring orders.
  • Email and SMS marketing platforms — currently Klaviyo, which stores subscriber profiles, consent records, and engagement history and sends messages on our behalf.
  • Analytics providers — including Google Analytics, which helps us understand site usage.
  • Advertising platforms — including Meta (Facebook and Instagram), which we use to deliver and measure advertising. Disclosing information to these platforms for cross-context behavioral advertising may be considered a "sale" or "share" under certain state privacy laws. See Your Privacy Rights below.
  • Product review platforms — to collect, store, and display customer reviews.
  • Customer service tools — to manage and respond to support inquiries.
  • Professional advisors — attorneys, accountants, and insurers, where reasonably necessary.
  • At your direction — where you request or consent to disclosure, such as through social media widgets or login integrations.
  • Legal and safety recipients — law enforcement, regulators, or others where we believe disclosure is required by law, necessary to enforce our Terms of Service, or necessary to protect the rights, property, or safety of Crescent, our customers, or the public.
  • Business transfers — in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, personal information may be transferred as part of that transaction.

Except for the advertising disclosures described above, we contractually require our service providers to use personal information only to perform services for us and prohibit them from using it for their own purposes.

Relationship with Shopify

Our store is hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit through the Services is transmitted to and shared with Shopify, and may be processed in countries other than the one where you reside.

In addition, we use certain Shopify enhanced features that incorporate data from your interactions with our store, with other merchants, and with Shopify. To provide these features, Shopify may use personal information collected about those interactions. In these circumstances, Shopify is independently responsible for that processing, including for responding to requests you make regarding it.

Depending on where you live, you may exercise certain rights directly with Shopify, including opting out of the use of your data for personalized advertising across merchants, through the Shopify privacy portal.

Advertising and Analytics Choices

In addition to our cookie preferences tool, you can limit interest-based advertising through the following:

  • The Shopify privacy portal at https://privacy.shopify.com/en, for advertising based on your activity across Shopify merchants.
  • The Google Analytics opt-out browser add-on, available from Google.
  • Ad settings within your Meta, Google, or other platform account.
  • Industry opt-out tools operated by the Digital Advertising Alliance and the Network Advertising Initiative.
  • Device-level settings such as "Limit Ad Tracking" or "Opt out of Ads Personalization" on iOS and Android.

Email and Text Message Communications

Email. If you subscribe or make a purchase, we may send you marketing emails. You can unsubscribe at any time using the link at the bottom of any marketing email, or by emailing privacy@crescentlabs.co. You will continue to receive transactional messages about your orders and subscriptions.

Text messages. We send marketing text messages only to customers who have provided express written consent. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP to any message, or reply HELP for assistance. Consent to receive marketing texts is not a condition of any purchase. Our SMS provider's messaging terms and messaging privacy policy govern the technical delivery of these messages and are linked at the point of signup.

Subscriptions and Payments

If you enroll in a subscription, our subscription provider stores a payment token that allows us to charge your payment method on the schedule you selected. We retain your subscription status, order cadence, next-charge date, and payment history for as long as your subscription is active, and afterward as needed for accounting, tax, and dispute resolution purposes. You can view, modify, pause, or cancel your subscription through your account or by contacting us.

Health Information

We do not ask for, and we do not knowingly collect, information about your medical conditions, diagnoses, treatments, medications, or health status. We do not offer a health assessment, symptom quiz, or similar tool. Please do not send us health information through our contact forms, email, or product reviews.

If we introduce a feature in the future that collects health-related information, we will provide a separate notice describing that collection and obtain any consent required by applicable law before doing so.

Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls on our systems, and security review of the vendors we work with.

No security measures are perfect or impenetrable, and information you send to us may not be secure while in transit. We cannot guarantee absolute security, and we recommend you do not use unsecured channels to send us sensitive or confidential information.

Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, taking into account whether we need the information to maintain your account, provide the Services, comply with legal obligations, resolve disputes, or enforce our agreements. In general:

  • Order and transaction records are retained for at least seven years to meet tax, accounting, and legal requirements.
  • Marketing subscriber profiles and consent records are retained while you remain subscribed and for a reasonable period afterward so that we can honor your opt-out.
  • Customer service records are retained for approximately three years.
  • Website analytics data is retained according to the retention settings of our analytics providers.

Your Privacy Rights

Depending on where you live, you may have some or all of the rights below. These rights are not absolute, may apply only in certain circumstances, and in some cases we may decline a request as permitted by law.

  • Right to know or access — request the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of recipients.
  • Right to delete — request that we delete personal information we have collected from you, subject to legal exceptions.
  • Right to correct — request correction of inaccurate personal information.
  • Right to portability — receive a copy of your personal information in a portable format, and in certain circumstances request that we transfer it to a third party.
  • Right to opt out of sale or sharing for targeted advertising — direct us not to sell or share your personal information for cross-context behavioral advertising or targeted advertising.
  • Right to non-discrimination — we will not deny you goods or services, charge you a different price, or provide a different level of service because you exercised a privacy right.
  • Right to appeal — if we decline your request, you may appeal that decision by replying to our response or contacting us at privacy@crescentlabs.co. Depending on where you live, you may also lodge a complaint with your local data protection authority.

How to exercise your rights

Email privacy@crescentlabs.co describing the nature of your request. To opt out of the sale or sharing of your personal information, use the "Do Not Sell or Share My Personal Information" link in our website footer, adjust your cookie preferences, enable Global Privacy Control in your browser, or email us.

To exercise rights relating to personal information processed by Shopify, including data used for personalized advertising across Shopify merchants, visit the Shopify privacy portal.

We will verify your identity before responding to a request to know, delete, or correct, typically by asking you to confirm information already associated with your account or orders. We respond within the timeframe required by applicable law, generally 45 days, with an extension where permitted.

You may designate an authorized agent to submit a request on your behalf. Before accepting a request from an agent, we will require proof that you authorized them to act for you, and we may need to verify your identity directly with you.

Do Not Sell or Share My Personal Information

Our use of advertising and analytics technologies may be considered a "sale" or "share" of personal information under the California Consumer Privacy Act and comparable laws in other states, because these technologies disclose identifiers and browsing activity to advertising partners for cross-context behavioral advertising.

As of the effective date of this Policy, we do not have actual knowledge that we sell or share the personal information of individuals under 16 years of age.

To opt out, use the "Do Not Sell or Share My Personal Information" link in our footer, adjust your cookie preferences, enable Global Privacy Control in your browser, or email privacy@crescentlabs.co.

Children's Privacy

Our products and website are intended for adults 18 years of age and older. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a person under 18, we will delete it. If you are a parent or guardian and believe a child has provided us with personal information, contact us at privacy@crescentlabs.co and we will delete it.

Visitors Outside the United States

Crescent is based in the United States and our products are primarily sold to customers in the United States. If you access our website or place an order from outside the United States, your personal information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those in your country.

If we transfer personal information out of the European Economic Area, the United Kingdom, or Switzerland, we rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses, or equivalent contractual terms issued by the relevant competent authority, unless the transfer is to a country determined to provide an adequate level of protection.

If you are located in the European Economic Area, the United Kingdom, or Switzerland, we process your personal information on the following legal bases: performance of a contract with you, our legitimate interests in operating and improving our business, your consent where required (including for marketing communications and non-essential cookies), and compliance with legal obligations. In addition to the rights listed above, you have the right to object to or restrict certain processing, the right to withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal, and the right to lodge a complaint with your local supervisory authority.

Third-Party Websites and Links

The Services may link to websites or online platforms operated by third parties, including social media platforms and retail partners. We do not control these sites and are not responsible for their privacy or security practices, or for the accuracy of information found on them. Our inclusion of a link does not imply endorsement. We encourage you to review the privacy policies and terms of any third-party site you visit.

Information you share on public or semi-public venues, including third-party social platforms, may be viewable by others without limitation on its use.

Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. When we do, we will post the revised Policy on this page and update the "Last updated" date above. If we make material changes, we will provide additional notice as required by applicable law, such as by email or a notice on our website. Your continued use of the Services after changes take effect constitutes acceptance of the revised Policy.
